All our prices include 21% VAT (exception: books 6% VAT) and exclude shipping costs. 

1. Orders and Payments

Payment options include: Bancontact, IDEAL, Credit Card, and PayPal.

Any inaccuracies in billing must be reported to De Hartjesdief immediately by the customer so that we can correct the amount.

2. Shipping

Worldwide delivery.

Shipments are made via Sendmyparcel with tracking for all packages.

For orders over 70€, there are no shipping costs to Belgium and the Netherlands. If your package is not picked up at the collection point and is returned to us, the return cost will be borne by the customer.

De Hartjesdief cannot be held responsible for damage, theft, or loss of goods during shipment via bPost, PostNL, or DPD.

We make every effort to package the goods as well and safely as possible.   

3. Discounts

Discount codes are only awarded to certain customers or customer segments, such as email subscribers. In case of misuse, we reserve the right to cancel the order.

Discount codes are not cumulative unless otherwise stated. Also, the discount codes do not apply to already discounted items.

4. Right to Withdraw from the Purchase of Goods - Right of Withdrawal

The consumer has the right to inform the seller that he is withdrawing from the purchase, without payment of a penalty and without giving a reason within 14 calendar days from the day following the delivery.

The buyer must return the product to the seller within 14 calendar days in its original condition, unused, undamaged, with all original labels and in the original packaging.

The seller undertakes to refund the purchase amount paid by the buyer for the product (excluding shipping costs) within 30 days of receiving the product.

If the return is not correct according to the above, the seller will not be obliged to pay any amount, and the product remains the property of the buyer. The buyer can then pick it up within 14 days at the seller's or, at the express request of the buyer and at the buyer's expense, have it returned to the buyer.

The risk of returning the product as well as the cost of returning it are solely borne by the buyer.

If the package is not picked up at the collection point and is returned to us, the return cost will be borne by the customer. 

5. Exchange

Not satisfied with your product? That's quite annoying. We try to resolve it as follows:

• 14-day cooling-off period after receiving your product
• For exchanges: we will send the new product free of charge

Items purchased through De Hartjesdief's online store can be exchanged within 14 days, starting from day 1 of delivery, provided that the product is unused, undamaged, and has all original labels. Worn, soiled, smoked, washed, damaged, or repaired goods cannot be returned.

We ask you to inform us within 5 working days if you wish to exchange a product.

The costs and risk of returning the products are solely borne by the buyer.

We reserve the right to refuse exchanges if we suspect that the product was damaged by the customer, has already been used, or if the reasons are unfounded.

Sale items or products on promotion cannot be exchanged.    

6. Complaints

We strive to describe and clarify the items offered as accurately as possible through photos.

If there are typographical errors (material errors), this is due to a human, involuntary error and no rights can be derived from this.

Colors in the photos may also slightly differ from the actual colors.

Settings and quality of your screen may have an influence on this, as well as the lighting.

We cannot accept exchanges based on color deviations.

If you have doubts about a particular product or need further information, you can always contact us for more information.

We reserve the right to adjust our prices.

We make every effort to thoroughly check our products for any errors or defects. If there are any defects in the items offered on our website, we are not liable for this. We ask you to contact the respective manufacturer. Please also inform us so that we can check the products more thoroughly.

We make every effort to prevent, remedy, and resolve any complaints.

We cannot be held liable for injuries or damages resulting from the use of our products.

7. Warranty

As required by legal provisions, our products also come with a legal warranty.

If a product does not meet the agreement, the buyer must inform the seller within 7 days following the delivery.

Any compensation for this can never exceed the invoiced/paid amount to the buyer. Normal wear and tear, accidental or intentional changes made by the buyer to the product, the inability to present an invoice or proof of payment, and various negligence are express but not limited exceptions to the aforementioned warranty system.

8. Ownership Right 

No data or photos from our site may be copied or used without our express permission.

9. Privacy 

In accordance with the new European privacy law, the General Data Protection Regulation, which has been in effect since May 25, 2018, we inform you on what grounds we collect and use data. 

We need your data as soon as you buy a product from De Hartjesdief, as this creates a contractual relationship. We use your data when processing your order, delivery, any returns, and contact with our customer service. 

In addition, we may also use your data for a legitimate interest. This is mainly to provide our customers with the best service and includes contact with customer service, giving reviews, customer satisfaction surveys, visiting the website, using an account on our website, the newsletter and email correspondence, possible personal advice, promotions and actions, social media.

In addition to legitimate interest, there may also be a legal obligation to use your data, for example in case of suspected fraud. Sometimes you have also given consent to use your data, such as when signing up for a newsletter. All of this is recorded.

Your data is only passed on to other parties if it is necessary to provide you with a better service. This includes delivery services, suppliers, payment partners, parties collecting reviews, or external parties providing IT-related services to our online store.

Data management platforms, media and advertising agencies, and research agencies come into play when we show targeted ads based on your interest in certain products.

The parties that have access to your data from us may only use it to provide you with a service on behalf of De Hartjesdief. We never sell your data to third parties.

Your data is stored in various databases and is not kept longer than necessary. We delete inactive customer accounts after 7 years. We adhere to this period because we are required by tax legislation to keep your payment details for 7 years. After that, we can use the data anonymously for internal analysis.
